As Americans become more mobile, so too must their health information. Public health agencies are increasingly called on to electronically exchange health information outside their jurisdictional borders. Given differences in state privacy laws and local ordinances, such exchange frequently requires a data exchange agreement.
This guidance document was developed by JPHIT to provide practical advice and information to public health managers and staff who craft such agreements. The JPHIT association members who contributed to this document have years of experience developing such agreements—sample agreements from several of their respective program areas can be found below.
The guidance provided in this document includes why a particular provision might be necessary, as well as thoughtful advice to consider as you craft that provision. Mostly, the document will help prepare you for conversations with your agency attorney, a step that is critical to achieving an agreement that will stand the test of time.
